1. Who We Are

Always Keep Me is operated by Jittercat (Pty) Ltd (registration number 2026/570232/07), registered and operating in the Republic of South Africa. This Privacy Policy explains what information we collect, how we use it, and what rights you have over it.

Information Officer

Our Information Officer is responsible for ensuring our compliance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and is registered with the Information Regulator of South Africa. 2. Information We Collect

When you use Always Keep Me, we may collect the following information:

• Your email address (for order confirmation, retrieval, customer support, and communication about your keepsake)
• Audio or video files that you voluntarily upload
• Custom text, titles, and design preferences that you provide
• We do not store any payment details of any sort other than the payment ID provided by the payment processor and the timestamp of the payment
• Technical information such as browser type, device information, and usage logs for security, fraud prevention, diagnostics, and service improvement

Security infrastructure and IP addresses

We use Cloudflare to deliver and secure this website. As part of standard security operations — such as mitigating distributed denial-of-service (DDoS) attacks, filtering malicious bots, and rate-limiting abusive traffic — Cloudflare's systems process visitor IP addresses on our behalf. This processing happens automatically for all traffic to our Service and is retained for up to 7 days. We do not separately store your IP address in our own database. Why we retain your payment reference

Because every memory on Always Keep Me is finalised only after payment, the payment reference tied to your order (issued by Peach Payments) is retained alongside your email address and the date of creation. We collect this because Always Keep Me lets people upload voice and video recordings, and if a specific upload turns out to contain illegal content (for example, child sexual abuse material, or content that infringes someone's rights, or content used to harass or defraud), this reference is what allows a court order or law enforcement request to be directed to our payment processor to help identify who made the purchase. We use it to:

• Respond to reports that a specific memory contains illegal or abusive content
• Comply with lawful requests from courts, law enforcement, or regulators (see Section 10, Sharing of Information)
• Investigate suspected fraud, abuse, or violations of our Terms of Use

This is why deleting a memory through our self-service deletion tool removes your audio, image, and QR code from public access, but the payment reference and order date are retained even after deletion — this is necessary so the information remains available to respond to exactly the kind of report described above. We do not use this information for marketing, analytics, or to build a profile of your behaviour across the Service, and we do not share it with anyone except in the circumstances described in Section 10.

You should not upload confidential or sensitive information such as passwords, banking details, identity documents, medical records, confidential business information, or other information that you would not want others to access.

3. How We Use Your Information

We use your information to generate your personalized memory image, store your audio for QR code access, process payment, provide customer support, communicate with you about your order, and maintain the security of the Service. We do not use your data for marketing, and we do not sell it to advertisers or share it with data brokers.

4. Data Storage & Security

Your uploaded files and generated keepsakes are stored using cloud infrastructure operated by trusted third-party providers. We implement reasonable technical and organisational safeguards designed to protect your information against unauthorised access, alteration, disclosure, or destruction.

However, no method of electronic storage or transmission over the Internet is completely secure. While we take reasonable steps to protect your information, we cannot guarantee absolute security.

Always Keep Me is designed to preserve memories, not to act as a secure storage service for confidential or sensitive information. You are responsible for downloading and retaining copies of anything you wish to keep and should not rely on the Service as your only backup.

Cross-Border Processing

Some of our third-party service providers, including our cloud hosting infrastructure and the artificial intelligence provider behind Raiden, may process or store your information outside South Africa. Where this occurs, we take reasonable steps to ensure such providers offer a level of protection for your information that is substantially similar to the conditions for lawful processing under POPIA, whether through contractual safeguards, the provider's own certifications, or other legally recognised means.

Security Compromises

If we become aware of a security compromise that has resulted, or is reasonably likely to have resulted, in unauthorised access to or acquisition of your personal information, we will notify the Information Regulator and affected users as soon as reasonably possible, in accordance with our obligations under POPIA, and will provide sufficient information to allow you to take protective measures.

5. Users Outside South Africa

This Privacy Policy applies to all users of the Service regardless of location.

6. QR Code Access

Anyone who scans the QR code printed on your keepsake can access the linked audio without logging in. This is an intentional feature of the Service, allowing memories to be easily shared.

Because QR codes may be viewed, photographed, copied, or shared by others, you should carefully consider where you display your keepsake. Once a QR code or its underlying link has been shared, cached, indexed, copied, or stored by another person or third-party service, we cannot control or remove those external copies.

For this reason, Always Keep Me is not intended for storing confidential or sensitive information.

7. Raiden, Our AI Chat Assistant

Raiden is powered by a third-party artificial intelligence provider. Messages submitted through the chat assistant are processed by that provider in accordance with their own privacy practices.

We do not use chat conversations for advertising or marketing purposes. Information may be retained only as reasonably necessary to provide support, improve the Service, investigate abuse, protect the security of the Service, or comply with legal obligations.

Attempts to misuse, exploit, attack, or interfere with the Service through the chat interface may be logged and retained for security, fraud prevention, and legal enforcement purposes.

8. Consent for Voice Uploads

By uploading an audio or video file, you confirm that you have obtained consent from any person whose voice or likeness is included in the recording. If that person is a minor, you confirm that you have obtained consent from their parent or legal guardian.

Voice as Special Personal Information

Under POPIA, "biometric information" can include voice recognition. We do not use your audio for identification, verification, or profiling purposes — we store and play it back exactly as uploaded. To the extent your recording is nonetheless treated as special personal information under POPIA, we rely on your consent, given when you upload the file and agree to this Privacy Policy and our Terms of Use, as the lawful basis for processing it.

9. Your Rights

Under POPIA, you have the right to:

• Establish whether we hold personal information about you, and request access to it
• Request that we correct or delete personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, or misleading
• Object to our processing of your personal information on reasonable grounds
• Delete your keepsake and associated content at any time, as described below
• Lodge a complaint with the Information Regulator (see Section 12) if you believe your rights under POPIA have been infringed

To exercise any of these rights, contact us at [email protected]. Because most of what we hold about you is the content you directly uploaded and control, many of these rights are already available to you through the Service itself, in particular deletion.

Deletion

You may permanently delete your keepsake at any time through our self-service deletion page at alwayskeep.me/delete.

Deletion of your uploaded files, generated images, and associated QR code from our active systems is immediate and irreversible; once completed, it cannot be recovered by you or by our support team, consistent with our Terms of Use.

Limited backup copies may briefly persist in disaster recovery systems for a short period before being automatically overwritten; these backups are not accessible for day-to-day retrieval and are not a way to recover content you have deleted. We may also retain transaction records or limited information where required for accounting, fraud prevention, legal compliance, dispute resolution, or enforcement of our Terms of Use.

Before requesting deletion, you should download and retain your own copies of any content you wish to keep.

10. Sharing of Information

We do not sell, rent, or disclose your personal information to third parties for advertising or marketing purposes.

We may share information only when reasonably necessary to operate the Service, including with trusted service providers such as payment processors, cloud hosting providers, storage providers, and security providers. These providers may process information only on our behalf and only for the purposes of providing the Service. We enter into written agreements with these providers requiring them to keep your information confidential and secure, and to process it only for the purposes we authorise, consistent with our obligations under POPIA.

We may also disclose information where required by applicable law, court order, governmental request, or where reasonably necessary to protect our legal rights, enforce our Terms of Use, investigate fraud or abuse, or protect the safety of users or others.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or the Service itself.

The updated version will become effective when published on this page, and the "Last Updated" date will be revised accordingly. Continued use of the Service after changes become effective constitutes acceptance of the revised Privacy Policy.
